Lawsuit seeking $45 million in damages filed against Seastreak in ferry crash

NEWARK — The family of a Wall Street broker badly hurt in the New Jersey commuter ferry accident earlier this month is seeking $45 million for his injuries, as a stack of lawsuits on behalf of other passengers began to hit federal court.

In the past two days, at least five lawsuits have been lodged against Seastreak, the ferry operator, and more are expected after the owners moved last week under maritime law to limit their total liability to the value of the damaged vessel — estimated at $7.6 million.

More than 70 people were hurt, some seriously, when the Seastreak Wall Street, bound for New York from Highlands in Monmouth County with 326 passengers on board, slammed into a concrete slip while attempting to dock at Pier 11 in Lower Manhattan on Jan. 9.

Among those on board was John Urbanowicz, 39, of Red Bank, who has yet to regain consciousness, said his attorney, Norman Hobbie of Eatontown. On his way to New York where he works as a broker, Urbanowicz was thrown forward by the impact of the crash and remains in intensive care at New York Presbyterian Hospital.

"He has substantial injuries," Hobbie said. "He suffered a fractured skull and a fractured jaw."

The lawsuit, citing gross negligence on the part of Seastreak, is seeking $45 million in damages.

Three other lawsuits were also lodged by Hobbie on behalf of other passengers, including Samantha Bremekamp, 29, of Atlantic Highlands, who suffered a spinal fracture. She is seeking $10 million in damages. Charles Lucia, 46, of Monmouth Beach, is seeking $3.5 million. His brother, Anthony Lucia, 51, of West Allenhurst, is seeking $2.5 million.

"These are very serious claims from passengers who did nothing wrong, who paid money to be transported from one location to another and were seriously injured," Hobbie said.

Another Monmouth County man, Desmond Sullivan, 42, of West Long Branch, who suffered back injuries, also filed a lawsuit against the ferry operator over the weekend.

The flurry of lawsuits was apparently sparked by Seastreak’s petition in federal court in Newark last week under an 1851 maritime statute limiting liability for injuries or cargo damaged or lost to the value of the vessel — but only if it can be shown that the incident happened without the knowledge of the owner.

Under the "limitation of liability" petition, the company set the ferry’s value at $7.6 million.

Under the statute, Seastreak also sought an order that would consolidate all claims against the company to federal court. The filing put in motion a May 15 filing deadline for anyone seeking damages.

Thomas Wynne, a spokesman for Seastreak, said the company is still trying to resolve injury claims by passengers willing to forego legal action, but had expected the move in federal court would spark the lawsuits now coming in.

"This is exactly what we anticipated," he said. "People were going to file lawsuits anyway and we want to make sure our passengers know where the claims need to be taken and the time limit on filing claims."

Meanwhile, Hobbie, in a separate motion in federal court, argued the ferry was not seaworthy at the time of the accident and that any limitation of liability — if accepted by the court — should not be restricted by the value of the damaged ferry, but for all the vessels under Seastreak’s command.

Much attention is expected to focus in the coming months on the ferry’s refitting last summer, when the 140-foot boat underwent major modifications. Its jet drive propulsion system was replaced with new engines, rudders and variable pitch propellers. The modifications reduced the vessel’s overall weight and reduced its top speed from 38 knots to 35 knots, but increased its fuel economy and lowered its cost of operation.

The captain of the ferry, in interviews with the National Transportation Safety Board, said the controls and engines failed as he tried to dock.

None of the other Seastreak ferries has been similarly modified, Wynne said.

As the weather here in New Jersey gets warmer and thoughts of summer are dancing in our heads, I like to gear up and get ready to enjoy my favorite seaside restaurants and bars.One of my favorites is Mister C’s Beach Bistro in Allenhurst, NJ. As the weather here in New Jersey gets warmer and thoughts of summer are dancing in our heads, I like to gear up and get ready to enjoy my favorite seaside restaurants and bars.

One of my favorites is Mister C’s Beach Bistro in Allenhurst, NJ. The restaurant has a slight overhang over the beach capturing the beauty of the ocean and a clean beach.

The restaurant boasts one of the most magnificent views on the Jersey Shore. I feel that I’m at an upscale beach club without having to pay the monthly dues.

I so enjoy the dining, cocktails and atmosphere of Mister C’s Beach Bistro – Bar in Allenhurst. The restaurant was built in 1931 to look like the outer shell of an ocean liner. The restaurant boasts one of the most magnificent views on the Jersey Shore. I feel that I’m at an upscale beach club without having to pay the monthly dues.

The restaurant is well appointed, the staff and food are on point and you truly feel that you’re on vacation when you enter Mister C’s. Owners Karen Marzulli and Chic Perrotto (Mister C himself) have been partners for close to 30 years.

The success of Mister C’s began in 1991 in Deal; they then moved and opened their current restaurant in Allenhurst in 2006. Karen and Mister C worked hard in refurbishing and rebuilding the restaurant after Hurricane Sandy did some devastating damage. They did a wonderful job.

The restaurant is expansive and also is a great location for small private parties. You have to check out the deck and the view; it’s awesome, so much so, I used the deck to include my picture for the cover of this book.

I enjoy the selection of food and cocktails at Mister C’s. My favorites are the tuna tartar, the Ahi Tuna Nachos and calamari/shrimp with Tai chili glaze. All of these are very good. Chef Tony Ibanez spent time at Le Cirque in New York and continues to put together some great dishes with the Jersey Shore flair and feel. He put a meatball on the appetizer menu and I have to tell you it rivals some of the best Italian restaurants.

Chef Tony has prepared for this cookbook a Coast to Coast Crab Cake. Chef spent some time in California and now lives here in New Jersey and has infused a little bit of both coasts in making this delicious recipe.

Mister C’s has claim to an award winning mixologist in Kevin Harvey. He is awesome and knows his cocktails; in fact Kevin was selected as our guest bartender for this cookbook. I’m happy we can include him.

You have to try his amazing drinks while checking out the amazing view and enjoying great dishes from the extensive menu. Mister C’s does it right, make it a part of your dining destination, you’ll be very glad that you did, I certainly am.

Mister C’s Coast to Coast Crab Cakes

Ingredients:

Half duchess crab / half lump crab

1 Egg

3 oz of crushed Ritz crackers

2oz of chopped celery

3 dabs of Hot Sauce ( I like cholula)

a teaspoon of Dijon mustard

a teaspoon of lemon aioli ( Lemon juice and mayo)

Directions:Put all ingredients in a large Mixing bowl. Mix ingredients gently. Make a 3 oz ball with the ingredients and place it into the crushed Ritz crackers covering the crab meat. Cook for a few minutes. Goes great over a salad ! Serves two !

ALLENHURST - Swift action by a federal district court has cleared the way for a Sephardic Jewish congregation to build a synagogue in the borough.

Ohel Yis'hak Sephardic Synagogue of Allenhurst and Rabbi Moshe Shamah filed a complaint Jan. 23 challenging a borough land use law barring it from building a house of worship.

The court resolved the issue the same day, issuing an order to permit the synagogue plan to go forward.

"The reason you have such a quick resolution is both sides were in agreement. We have great respect for the rabbi and his entire community. This was simply a technical issue with our zoning laws, which is being resolved," said Borough Attorney David A. Laughlin.

The group based its case on the federal Religious Land Use and Institutionalized Persons Act, which protects individuals and organizations from land use laws that constitute an undue burden on their religious exercise.

Shamah owns a home at 108 Allen Ave., where he was lawfully holding prayer services.

He was seeking to convert his home into a synagogue to accommodate a growing Sephardic Jewish population, especially in the summer, when 50 percent of Allenhurst's population is Sephardic Jews, according to court documents.

There are no synagogues in Allenhurst, but the borough is not without houses of worship.

People literally go crazy for this place. Many will say that they offer the best steak not only at the Jersey Shore, but in all of New Jersey. The reviews are incredible, and somehow someway my girlfriend was able to make reservations for six. The other night It was me, my girlfriend, my cousin, his fiancé, my best friend and his girlfriend. For all six of us, it was our first time ever eating at The Butcher's Block...

It's pretty simple, The Butcher's Block is incredible. I am giving this Monmouth County restaurant 5 solid stars. First, the newly renovated building is fantastic inside and out. The ambiance is top of the line. Before even talking about the food, I want to give a shoutout to The Butcher Block workers. It was one of the best dining experiences I ever had. The service was incredible, you can really see that the workers take pride in what they do.

Now the food, to be honest, I don't even know where to start. For appetizers we got the steak tartare, margherita pizza, and a Caeser salad. All of the starters were tremendous, but I think the best thing was the wagyu rigatoni Bolognese. Good god almighty, it was easily the best Bolognese I ever had.

After that we got a couple of steaks. We ordered the wagyu tomahawk and the ribeye. Just two steaks, but they are so big that they can easily feed a hungry table of six. Hands down some of the best steaks I ever had. I think I would have asked for it to be cooked a little more next time, but I know I know, that would be insulting. All in all, an A+ meal.

The Butcher's Block is located at 235 West Ave, Long Branch, NJ 07740. I highly recommend you trying to get reservations for a special night out. Is it expensive? Yes, but it's totally worth it! The six of us already made reservations to go back in September. I can't wait!! SEE YOU THERE.

Property taxes in Monmouth County have risen faster than the rest of the state over the last five years, new state data shows.

Property taxes have risen by an average of 13% in Monmouth County since 2017, compared to 9% in the rest of the state, according to data from the state Department of Community affairs, released last month.

Taxes increased in every town in Monmouth County over the five-year span except Loch Arbour, which has a permanent population of less than 250 people.

Asbury Park saw the highest property tax hike since 2017, where the average tax bill rose by more than 35 percent.

Here is how property taxes changed in each town in Monmouth County, from 2017 to 2022:

Aberdeen Township

In Aberdeen Township, the average property tax bill was $8,096 in 2022. Data show the average tax bill here has increased by 11.93% since 2017, or $863.

Allenhurst Borough

In Allenhurst Borough, the average property tax bill was $17,267 in 2022. Data show the average tax bill here has increased by 30.33% since 2017, or $4,018.

Allentown Borough

In Allentown Borough, the average property tax bill was $8,876 in 2022. Data show the average tax bill here has increased by 0.74% since 2017, or $65.

Asbury Park City

In Asbury Park City, the average property tax bill was $7,048 in 2022. Data show the average tax bill here has increased by 34.53% since 2017, or $1,809.

Atlantic Highlands Borough

In Atlantic Highlands Borough, the average property tax bill was $9764 in 2022. Data show the average tax bill here has increased by 8.31% since 2017, or $749.

In Avon-by-the-Sea Borough, the average property tax bill was $10,903 in 2022. Data show the average tax bill here has increased by 12.74% since 2017, or $1,232.

Belmar Borough

In Belmar Borough, the average property tax bill was $7,868 in 2022. Data show the average tax bill here has increased by 17.78% since 2017, or $1,188.

Bradley Beach Borough

In Bradley Beach Borough, the average property tax bill was $8,487 in 2022. Data show the average tax bill here has increased by 15.56% since 2017, or $1,143.

Brielle Borough

In Englishtown Borough, the average property tax bill was $7,819 in 2022. Data show the average tax bill here has increased by 14.48% since 2017, or $989.

Fair Haven Borough

In Fair Haven Borough, the average property tax bill was $16,885 in 2022. Data show the average tax bill here has increased by 15.58% since 2017, or $2,276.

Farmingdale Borough

In Farmingdale Borough, the average property tax bill was $7,934 in 2022. Data show the average tax bill here has increased by 26.48% since 2017, or $1,661.

Freehold Borough
