A former middle school student in Middlesex County has filed a lawsuit against Perth Amboy Public Schools alleging the district should have done more to stop a school security guard from sexually assaulting her several years ago.
The student, who now lives in another state, claims in court papers that district officials knew or should have known that Elios Arias had “a propensity to engage in inappropriate sexual contact with minor students.”
Arias, 30, pleaded guilty in 2019 to one count of second-degree sexual assault and was sentenced to seven years in prison. He was released on parole in December 2022 from the Adult Diagnostic and Treatment Center in Avenel after serving more than three years, according to the New Jersey Department of Corrections.
The student attended William C. McGinnis Middle School, where Arias worked as a security guard, according to the suit, filed Sept. 21 in Superior Court of Middlesex County.
During the 2016-2017 school year, Defendant Arias contacted the student through text message and social media, the lawsuit states.
“These social media contacts were public and could have been discovered upon reasonable investigation,” the suit states.
Perth Amboy district officials did not return calls multiple calls and emails seeking comment on the complaint.
Phone numbers listed for Arias were not in service and his attorney’s information was not contained in civil court documents.
The lawsuit alleges that on two occasions in 2017, Arias told the victim to come to his home, where he sexually assaulted her.
She has since suffered from PTSD, depression and anxiety, according to the suit.
“(Her) injuries were avoidable by and through the exercise of ordinary care, safety, and due diligence in the hiring and supervision of staff at William C. McGinnis Middle School,” the suit states.
The lawsuit alleges the district was negligent and failed to properly supervise Arias, who allegedly had a reputation in the school for inappropriate contact with students.
The complaint accuses Arias of breaching his duty of care to the girl by making unwanted physical and sexual contact with her, engaging is psychological sexual assault “through visual and verbal behavior,” and of failing to respect or appreciate boundaries of minors in his care.
“The school defendants knew and/or should have known that their failure to discharge their obligations and duties to supervise their agents would result in, or likely result in the serious, severe, and permanent injuries that resulted,” the suit states.

PERTH AMBOY, NJ (MIDDLESEX)–Morris Habitat for Humanity is preparing to break ground on constructing two single-family homes on Pearl Place, hoping to welcome new families early next year.
The latest Habitat project in the city could not have happened without the Perth Amboy Redevelopment Authority (PARA), which sold two 25-foot by 100-foot lots.
“Our mission is not just about redeveloping large swaths of underused property,” explained PARA Executive Director Tashilee Vazquez. “We are focused on rebuilding neighborhoods and looking for all opportunities. On this small parcel, we can fulfill homeownership for two families. This is a tremendous investment in Perth Amboy and an ideal fit for our mission.”
PARA’s agreement allows for a partnership between Morris Habitat and the Perth Amboy Redevelopment Team for Neighborhood Enterprise and Revitalization (PARTNER), a non-profit that creates housing and economic opportunities for low- and moderate-income residents. Morris Habitat and PARTNER are serving as the project redevelopers.
Liz DeCoursey, CEO of Morris Habitat, anticipates a groundbreaking this summer. The three-bedroom homes will ultimately be sold to families who meet low-income guidelines. Still, the new residents must show the ability to pay an affordable mortgage, property taxes, utilities, and all other expenses related to home ownership.
The homeowner selection process will be random, but preferences will be given to veterans and current Perth Amboy Housing Authority residents. Anyone interested in applying for a home should contact Morris Habitat.
The Pearl Place project is the latest venture for Morris Habitat in Perth Amboy, as the non-profit steadily increased its footprint in Middlesex County since it took over the territory in 2020. Homes have already been completed at 440 Lawrie St. and 662 Cortland St., while others are now under construction at 363 Inslee St. and 364 Garretson Ave.
Both Vazquez and DeCoursey expressed their appreciation to Doug Dzema, executive director of PARTNER and the Perth Amboy Housing Authority, for working closely with Morris Habitat, PARA and other program supporters to build quality, affordable homes in the city.
Morris Habitat has precise stipulations for the homes it builds. For example, all must be designed as “user friendly” as possible, with Energy Star appliances, maintenance-free materials, a single garage, handicap accessibility, the ability to use side and rear yards for recreation, and plenty of storage space. All homes are for sale; there are no rentals.
“We are excited to see Morris Habitat transform unused and neglected spaces into valuable assets for our residents, thereby enhancing the neighborhoods of Perth Amboy,” said Mayor Helmin Caba of Perth Amboy. “We look forward to working closely with all of our redevelopment partners to turn our collective vision for a rejuvenated city into reality.”
DeCoursey noted Morris Habitat also has plans to serve at least 400 families over the next three years through its home repair and aging-in-place programs. Key team members are PARTNER and the Jewish Renaissance Foundation, leveraging grants to assist residents in two Perth Amboy neighborhoods.
Separately, Morris Habitat is set to begin building 12 homes in Old Bridge, at 200 Laurence Parkway.

City designates locations as ‘areas of in need of redevelopment’ — making them eligible for additional help from city for developers
The announcement of a program to renovate its New Jersey Transit station — a $45 million project that is expected to be completed in 2024 — was a big win for Perth Amboy.
The same can be said for the recently announced BridgePort II, Bridge Industrial’s more than 1 million-square-foot, high-capacity storage and distribution center, located on a remediated 73-acre waterfront site in Perth Amboy, which had its groundbreaking in April. That project is expected to bring 1,500 permanent jobs while generating $2.9 million in gross tax revenue.
That being said, the economic development leaders in Perth Amboy are not satisfied. They are looking for more renovated and reimagined growth for the Middlesex County city on the water with a population of approximately 55,000.
In fact, they are taking their pitch — and their parcels — directly to developers.
Last week, the city unveiled five specific parcels it deemed “areas in need of redevelopment.”
The designation, city officials said, will enable Perth Amboy to more easily approve redevelopment plans and create tax incentives and special financing that encourage developers to invest in targeted improvement projects.
The designation also will allow the city to be able to more easily condemn blighted properties as part of the overall effort to create quality development for the community’s overall benefit, Perth Amboy Redevelopment Agency Executive Director Tashi Vazquez said.
“For many years, these parcels have been underused and, in some cases, have been considered to be eyesores,” Vazquez said. “The city is now taking aggressive steps to encourage redevelopment in these targeted areas, as we believe the designation will have a positive ripple effect across entire neighborhoods.”
Vazquez said PARA is eager to work with Mayor Helmin Caba, the city council and the Perth Amboy planning board to market the properties to developers who share the same vision.
“Our focus is to create the type of uses for these properties that will be exciting for our residents,” Caba said. “We want walkable, mixed-use communities that create quality living and eclectic businesses. Through smart and ongoing redevelopment, we want to entice many more people to explore Perth Amboy and consider living and investing here.”

The Perth Amboy Redevelopment Agency (PARA) has signed an agreement with Viridian Partners of Denver to remediate and redevelop a 44-acre blighted assemblage of properties known as “Gateway.”
Under the deal, Viridian will invest more than $110 million to clean contaminated parcels of land between the Route 35 Victory Bridge, Smith Street and Riverside Drive. The project, once completed, is expected to generate more than 400 long-term jobs and $1 million in local tax revenue.
As part of the plan, more than nine acres of land abutting the Smith Street business corridor will be remediated and “pad ready” for the city at no cost. Perth Amboy officials will decide how best to redevelop the land.
In addition, the developer will remediate and improve an additional nine acres of land for Perth Amboy residents’ passive recreation, including natural areas surrounding Sonnaman’s Creek, with trails leading to a gazebo on a hill to be constructed overlooking the Raritan River.
About 25 acres will be used to construct a one-story, 471,000-square-foot, Class A, state-of-the-art warehouse. Trucks accessing the warehouse must use Riverview Drive via its intersection at Smith Street to minimize traffic in business and residential areas. In addition, berms, buffer landscaping, and other natural screens will be used to minimize the impacts of the warehouse development.
“We’re eager to take advantage of the commercial possibilities of this large swath of developable property and maximize its ideal proximity to Route 440 and other major highways,” said Perth Amboy Mayor Helmin J. Caba. “Working closely with PARA and the developer, we are moving forward with a three-pronged strategy. The developer is paying to remediate the land, create a public park, and turn nine acres of valuable land into buildable property as part of our overall downtown redevelopment initiatives.”
PARA selected Viridian Partners because of the firm’s experience in remediating contaminated complex properties in Middlesex County and converting large industrial sites into clean, tax-generating uses.
As part of its portfolio, the company launched the ePort 1 warehouse project along 102 acres of the Arthur Kill in Perth Amboy and redeveloped a 400-acre former munitions plant in Cranbury. The site now includes warehouses for Amazon and Wayfair; 150 of the 400 acres are maintained as clean conservation areas.
Michael Cahn, a principal with Viridian Partners, said about 75% of the company’s developments are concentrated from Burlington County to Union County, as the 20-year-old firm seeks environmentally distressed properties near the New Jersey Turnpike and other major highways. Its other large developments are based in Florida, California, and Pennsylvania.
“What excites us about the Gateway project is its phenomenal proximity to highways; it is a perfect fit for our model of remediating complex properties,” said Cahn, noting there is also a landfill on the site the firm will address. “We are eager to move forward with Mayor Caba and PARA, breathing new life into the entire neighborhood and directly addressing a blighted eyesore awaiting redevelopment for decades.”
The site formerly housed a roofing company that manufactured asbestos shingles, closing an estimated 23 years ago, Cahn said. Viridian Partners has been working with the city since 2014 to create the overall plan for the vast site; it requires the developer to assemble 28 parcels to comply with the redeveloper’s agreement.
PARA Executive Director Tashi Vazquez said the next step is for Viridian Partners to submit a site plan to the city’s Planning Board for review and secure approvals from Middlesex County and the state Department of Environmental Protection.
The redeveloper’s agreement calls for the developer to break ground no later than spring 2025. Cahn anticipates it will take one year to remediate the property, addressing all geotechnical issues, and a second year for vertical construction of the Class A warehouse and nine-acre open space area.
