MILLSTONE – Three agreements have been authorized by the Township Committee that will clear the way for a trio of projects that will help Millstone Township meet its obligation to provide opportunities for the construction of affordable housing in the community.

The obligation to provide affordable housing has been mandated by New Jersey’s courts, which determined the former New Jersey Council on Affordable Housing was not enforcing regulations to create affordable housing which the New Jersey Supreme Court ruled must be constructed throughout the state.

Affordable housing is defined as housing that is sold or rented at below market rates to individuals and families whose income meets certain guidelines. According to township officials, Millstone’s obligation is 231 affordable housing units.

On March 18, committee members passed three resolutions authorizing agreements to create residential developments that will contain affordable housing units. Two agreements are with the Affordable Housing Alliance (AHA) and one agreement is with Gerald Baldachino of Baldachino Properties.

The AHA is a nonprofit corporation that works with municipalities to assist with affordable housing compliance. AHA has previously assisted Millstone Township with other affordable housing developments.

The agreement with Baldachino will provide for a proposed development that will be a mix of market rate housing and affordable housing, according to municipal officials.

The plan from Baldachino Properties may propose a maximum of 240 units, with 48 units designated as affordable housing. The location would be at 710-711 Perrineville Road (Route 1), which is owned by Baldachino, and is a 45-acre parcel.

One agreement with AHA will provide for a project to be known as CKV Millstone Woods. According to the resolution, the proposed development will have 49 single-family homes, all of which will be marketed as affordable housing. The location is 27 Burnt Tavern Road.

The second agreement with AHA will provide for a project to be known as Shu Lee Apartments at 8 Novad Court, off Route 537 near Interstate 195. The development will consist of 30 rental apartments, all of which will be designated as affordable housing, according to the resolution.

The parcels at 27 Burnt Tavern Road and 8 Novad Court are owned by Millstone.

The resolutions for the proposed developments at those locations state that Millstone officials have committed to transferring ownership of both parcels to AHA at no cost to facilitate the construction of the affordable housing and to enhance the economic feasibility of the projects.

With the exception of the Baldachino development, which will include market rate housing and affordable housing at the same location, municipal officials have said that in meeting the 231-unit obligation, Millstone’s affordable housing projects will consist entirely of affordable housing units.

MILLSTONE TOWNSHIP - Three warehouses and an indoor recreation center located within a mile of each other could be coming to Route 33.

The four proposed buildings come during a spate of development proposals along Route 33 in recent years that include the new 1.22-million-square-foot Millstone 8 Logistics Center, which sits on the site of the former Showplace Farms.

Here is a rundown of the proposals, which come soon after Planning Board officials tore into a proposal to build 170 townhouses and apartments on Perrineville Road.

The township, which is mostly rural, has easy access to highways and is close to the New Jersey Turnpike, which makes it attractive to warehouse builders.

XXXIII Associates/Riverside Center

A 62,400-square-foot warehouse is proposed to be built behind Route 33, in the pocket of land south of where DeBaun Road and Farrington Boulevard intersect.

The development is proposed to be directly across from Monroe Township’s Amazon warehouse.

According to site plans by the Freehold-based developer XXXIII Associates/Riverside Center LLC, 60,000 square feet of the building will be for the warehouse while 2,400 square feet will be for office space.

According to a stormwater management report, the developer asked that the property be divided into two separate lots of 5.85 acres and 5.97 acres. The proposed warehouse would be located in lot A with 5.85 acres.

Lot B at 5.97 acres would house a proposed assortment of retail buildings that are not part of the current proposal before the planning board. The future planning board application would contain four retail buildings that total 18,281 square feet.

The development has been before the planning board since April and it will be discussed at the next planning board meeting on Wednesday, July 13.

Warehouse building boom:Here's how you created it

Force 5 Holdings

Directly across Farrington Boulevard from the proposed warehouse is the location of a proposed two-story indoor recreation center.

A Monroe-based company called Force 5 Holdings LLC applied with the township to develop the recreation center, but the owner of the property is the Freehold-based XXXIII Associates / Riverside Center.

According to site plans, the recreation center is proposed to house an arcade, laser tag, cricket courts, pingpong tables, a badminton court, party rooms, locker rooms and an office.

To build the facility, 4.4 acres of the total 12.86 acres are proposed to be disturbed.

The developer proposed that the recreation center be open seven days a week, from 6 a.m. to 11 p.m. It anticipates the recreation center will see five to 10 employees throughout the day and 50 to 80 customers.

The recreation center has been before the planning board since June. It will be discussed at the next planning board meeting on Wednesday, July 13.

Warehouses:Manalapan punts decision on warehouse near Monmouth Battlefield to Zoning Board

AACDML Property

About half a mile away on the other side of Route 33, another warehouse is proposed.

Site plans for this warehouse by the Englewood-based AACDML Property call for 130,000 square feet of warehouse space and 6,000 square feet of office space.

Its address is at 535-589 Route 33, in the wooded area east of Millstone Road and the Millstone River.

According to an environmental impact report, the entire property is 136 acres and it is located in the Millstone Watershed Management Area, the Millstone River watershed and the Millstone River subwatershed. The land has not been previously developed.

The project will be heard before the planning board on Wednesday, Aug. 10.

Warehouses:Controversial Howell warehouse proposal, rejected once already, back with smaller plan

Across Route 33 and less than half a mile to the east of the proposed AACDML warehouse, another warehouse is proposed to be built on the former Hole-in-One golf center.

The Readington Township=based JLE LLC has submitted a proposal to build a structure with 282,252 square feet of warehouse space and 9,600 square feet of office space.

It’s address at 530 Route 33, would neighbor the Indian restaurant The Chozhas and be located near residents living along Arrowhead Way and Winding Creek Drive.

It will be before the planning board on Wednesday, Aug. 10.

MILLSTONE – Testimony regarding an application that proposes a residential development consisting of market rate and affordable housing in Millstone Township continued during a special meeting of the Planning Board on June 29, but no vote on the project was taken that evening.

During the meeting, members of the board questioned the applicant’s representatives on a number of items, including plans for the development’s water and sewer systems.

Hexa Builders, LLC, is seeking preliminary and final major site plan approval to construct a development at 711 Perrineville Road, Millstone Township, near Route 571 and the border of East Windsor. The application proposes the construction of 170 residential units.

Prior to June 29, the application was heard on March 9 and May 11. Attorney John Giunco represents Hexa Builders.

The Hexa Builders application has now been carried to the board’s July 13 meeting, although it may not be heard that evening. Instead, the board may announce the date of another special meeting on which the application will be heard.

Representatives of Hexa Builders have said the development at 711 Perrineville Road will consist of 18 buildings on a 36-acre lot. There will be 122 townhouses constructed in 16 buildings and 48 condominiums constructed in two buildings.

The townhouses will be sold at market rates and the condominiums will be marketed for sale under New Jersey’s affordable housing guidelines, according to the applicant.

The proposed development was initially announced by municipal officials in 2019 as part of the township’s plan to provide opportunities for the development of affordable housing in the community.

All of Millstone Township’s previously approved and constructed affordable housing projects contain only affordable housing units. Those developments are referred to as 100% affordable housing projects.

The project envisioned by Hexa Builders is the first development proposed in Millstone Township that would include a combination of market rate homes and affordable housing units. This type of development is referred to as an inclusionary project.

The property is owned by Gerald Baldachino, who presented the township with the initial plan to develop the property on Perrineville Road.

During the June 29 meeting of the Planning Board, engineer Gregg Barkley, representing the applicant, testified about the development’s waste water treatment facility.

Millstone Township does not have a public water system or sewer system, so the developer would need to create that infrastructure specifically for the project.

Barkley said the development’s waste water treatment facility would meet New Jersey’s standards. He described the facility as a recharge system that would generate water similar to a natural stream.

“It’s not like a septic system. It’s a lot cleaner than that,” he said of the proposed treatment facility.

Barkley explained that the primary purpose of the treatment facility would be to remove nitrates from the system and turn it into nitrogen gas.

“This is a primarily biological process, but there is some chemistry involved,” he said.

Barkley said a treatment facility operator who is licensed by the New Jersey Department of Environmental Protection (DEP) would be present at the site and a truck would remove the waste water from the development.

Barkley said the treatment facility has been designed to handle 49,200 gallons of water per day and would receive an estimated daily average of 25,000 gallons of water.

When asked about the infrastructure by board members, Barkley said the tanks have an estimated lifespan of more than 50 years.

Board members expressed concern the treatment facility’s pipes, which are proposed beneath an open space field, would harm the surrounding area.

“I am concerned this (will go) back to the people who live in town and they will have an extra bill,” board Vice Chairman Chris Pepe said.

In response, Barkley said the pipes would be part of a monitoring process.

Pepe was critical of the water treatment system’s design not being completed by the time of the meeting.

“We (the board) would be voting on something that has not been completed,” he said.

Another concern for the board was the residential development’s proposed water system. When asked by board members, Giunco acknowledged the applicant did not have a water system expert.

The board members indicated they believe an expert should testify as to how the development will use its water system.

Giunco said the development’s water system is under the state’s jurisdiction and the attorney said the applicant is still awaiting approval from the DEP.

As testimony concluded for the evening, Planning Board Chairman Mitchell Newman requested that the public hearing be carried to the board’s next meeting on July 13.

Giunco said the delay on a decision regarding the Hexa Builders application was “unreasonable,” but Pepe said the application was missing too much information for a decision to be made.

“You (the applicant) failed to make deadlines,” Pepe said.

Newman said the Hexa Builders application would be carried to July 13, but likely not heard because there are other applications on the agenda and because that meeting will be held in the municipal courtroom.

The Hexa Builders meetings have been held in a larger building at Wagner Farm Park.

Newman said the municipal courtroom cannot accommodate the number of people who want to hear the Hexa Builders application. He said on July 13, the board is likely to determine the next date on which the application will be heard.

JACKSON - A group of nearly two dozen residents is suing the township Zoning Board and developer planning to a build a sprawling sports and entertainment complex near Six Flags Great Adventure.

In a complaint filed Thursday in state Superior Court in Toms River, 22 people living on Anderson Road, Perrineville Road and Holly Tree Court requested the court reverse approval of the Adventure Crossing project. The project received major site plan approval on Jan. 30 and was finalized on May 1.

The plaintiffs in the case are:

The lawsuit alleges that the approval was "arbitrary, capricious, unreasonable, unlawful ... and against the great weight of the evidence presented to (the Zoning Board)."

WHAT'S GOING THERE? Jackson sports complex starts to rise near Six Flags

The suit does not specifically describe why the application or the Zoning Board's approval of it were unlawful.

Millstone developer Vito Cardinale has called the $500 million project "one of the greatest sports and entertainment facilities in the Northeast when we're all said and done," intending to turn 300 acres in the middle of Jackson into a destination for families traveling from out of state for youth sports tournaments.

The crown jewel and namesake of the project is Adventure Sports & Entertainment, a 120,000-square-foot indoor sports dome with five basketball courts, a soccer field, sports bars, shops and rooms for parties and education.

FLASHBACK: Ground broken on Adventure Sports & Entertainment in Jackson

The project also includes plans for another 100,000-square-foot building with a trampoline park, go-kart racing and video game competition area, as well as two hotels — a Hilton Garden Inn and SpringHill Suites by Marriott.

The most recent phase of the project approved by the Zoning Board included a strip of eight restaurants, including some with drive-thrus, and retail sites, as well as a gas station and convenience store.

Future phases would include a third hotel, an expo center, golf and hockey centers, an outdoor stadium, apartments and a brain research center focusing on multiple sclerosis, with apartments for people with disabilities.

Ground was broken last year on the the first phase of the project, including the dome and first hotel, which was expected to open as soon next year.

The entire Adventure Crossing project is expected to take at least a decade to build.

Cardinale said Friday night that he wasn't aware a complaint had been filed related to the Adventure Crossing but did not provide further comment.

Bo Smith's Thoroughbred breeding program may be small—it has four mares and the 10-acre Smith Farm and Stable near Millstone, N.J.—but you can't say it's been inconsequential.

At the recent Fasig-Tipton July select sale in Lexington, Smith and consignor Joe Dodgen looked at the catalog page for Smith's Hip 88, a Malibu Moon filly they sold for $250,000 to pinhooker Nick De Meric.

"I bred everybody on the page and raced the ones we didn't sell," said Smith, who got his start in the Thoroughbred game with the mare listed at the very bottom of Hip 88's catalog page, a multiple stakes winner named Fancy Pan, the sale yearling's fourth dam.

Fancy Pan, by Paavo, was the first racehorse that Smith ever owned. Smith and partners bought her as a 4-year-old in 1987 and campaigned her in the name of Gunsmith Stables. When they bought her for $37,000, Fancy Pan was a claiming runner, but she bloomed into a multiple stakes winner for the Gunsmith partners and trainer Mark Perlsweig. She retired in 1989 as the winner of the 1988 Omnibus Stakes at Monmouth and the 1989 Lady Baltimore Handicap at Pimlico. She had six other stakes-placings to her credit, too, and left the track with $237,060 in career earnings—most of them for Smith and partners.

Fancy Pan's retirement put Smith in the breeding business. That's when Dodgen got involved in the story, shortly after Fancy Pan produced her first foal, a Lord Avie filly named Avie's Fancy.

"They brought Fancy Pan to me when Avie's Fancy was three weeks old," said Dodgen, whose Seven Fold Farm is located near Lexington. "We've been in business ever since. Bo sent me a card the other day with a copy of a bill from 1988 for Fancy Pan, and he said, 'Most marriages don't last this long'."

Avie's Fancy turned out to be a good one. She won eight stakes for Smith, including the Matchmaker Stakes (gr. IIT) in 1995 and the Boiling Springs Handicap (gr. IIIT) in 1994, and earned $402,909, then produced another stakes-winning filly, Our Cozzette, for Smith's racing string and broodmare band.

Things got even better when the Gunsmith partners took Avie's Fancy's 2001 foal, the Saint Ballado colt St Averil , to auction. He brought $500,000 when purchased by Darby Dan Bloodstock at Fasig-Tipton's 2002 July select sale and then continued the family's graded-winning tradition with a victory in the 2004 Santa Catalina Stakes (gr. II). St Averil also finished second to Lion Heart in the Hollywood Futurity (gr. I) and was on the Triple Crown trail for a time before sore front feet prompted owner Stan Fulton to sideline him.

Meanwhile, back at Smith Farm and Stable, Fancy Pan's granddaughter Our Cozzette had produced the Touch Gold filly Our Fantene , who developed into yet another stakes winner and stakes producer. When Our Fantene retired, the Gunsmith partners bred her to Outflanker and got the grade III winner Javerre . The 6-year-old gelding has been racking up black type and earnings from New Jersey to Pennsylvania to Maryland for Smith.

"I mostly stay in the mid-Atlantic region," said Smith, adding that he favors Pennsylvania racing, is just getting involved in Maryland, and also has two crops of Delaware-certified horses. "I have some good mares, and I have some modest mares, and the modest mares I don't breed to sell commercially. I know I'm not going to make a profit with them, but I run those foals in state-bred programs where I think they can make money on the racetrack."

Javerre won the 2013 General George Handicap (gr. III) and the 2012 New Jersey Breeders Handicap for state-breds. His third-place finish in the May 30 John J. Reilly Handicap at Monmouth Park increased his earnings to $470,309 and added a nice little update to Fasig-Tipton July Hip 88's catalog page before she went in the ring.

"It was a fair price for this market, at a sale early in the year," Smith said of the Malibu Moon filly's $250,000 price. "We're satisfied. She was well-prepped by Joe.

"It's a difficult thing for a small operation to keep a mare like that," he added. "One misstep, one problem, and you know you've thrown away a lot of what you could do with a quarter of a million dollars. So I just thought selling was a prudent thing to do. I would have loved to have kept her, and she would be an excellent addition to our broodmare band down the road, that's for sure."

The filly's dam, Our Fantene, has been visiting Kentucky stallions in recent breeding seasons—she has a Stay Thirsty colt by her side now and is back in foal to Curlin —but Smith keeps her at his 10-acre New Jersey property for most of the year.

"Joe's got a paddock bigger than that!" Smith said with a laugh.
